Probate is the process whereby legal title is transferred from the estate of the individual who has died to his or her heirs, beneficiaries and creditor. If there is no property in the decedent's Estate, or if all of the decedent's property was held in joint tenancy, then there is usually no need for probate. However, if an individual had a Will, but no Trust or no Will at all, then it will likely be necessary to place the Estate "in probate." The probate court's role is to supervise the distribution of a person's Estate in accordance with his or her Will or the laws of the State.
