When Is Annulment a Legitimate Option?
The technically correct terms for marriage annulments in California are "nullity of marriage" and "nullity of domestic partnership." Regardless of the term used, ending a marriage or partnership this way can only be done in certain situations. Examples include:
- Situations where one or both individuals were underage at the time of the marriage
- Situations where one or both individuals were already legally married to other people
- Situations involving a physical incapacity to consummate the marriage
- Situations where an individual was forced to enter into the marriage
- Situations involving legally insane individuals
- Situations involving marriage to a relative
- Situations where one individual perpetrated a fraud on the other
The result is that in the eyes of the law, the marriage never occurred. How other issues related to the relationship, such as child custody, child support, spousal support and property division are handled depends upon the facts and circumstances of each individual case.
